Learned Counsel for the applicant submits that as a matter of fact, the applicant was not present at the alleged place of incident and a false complaint has been filed. He submits that even if the allegations in the FIR are taken at its face value, no offence is disclosed and therefore, this application deserves consideration.

We have heard the learned Counsel for the applicant, & perused the allegations in the FIR.
