ORDER :

The application is filed for leave to grant appeal against the judgment and order of S.C.C. No. 917/2011 which was pending in the Court of J.M.F.C., Aurangabad. Nobody turned up for respondent Nos. 1 to 3. Seen the judgment delivered by the trial Court. The execution, giving of the cheque is not disputed. In view of the reasoning given, this Court holds that there is good arguable case in the appeal. In the result, the application is allowed. Leave is granted.
