Both the parties have settled the matter amicably and they have tendered on record the terms of the settlement, supported by affidavits of all the parties to the litigation. The parties were directed to approach the Registrar (Judicial) for verification and identification. Accordingly, a report to that effect is submitted, which is part of record. 2.

Parties have filed Civil Application No. 9506/2025 incorporating terms of settlement and they are praying to dispose of second appeal. 3.

With the assistance of the learned counsels, I have verified the parties, who are before the Court. I have also gone through the terms of settlement independently. I do not find that there is impediment in permitting the parties to settle the matter amicably and consequentially for disposal of the second appeal.

The Second Appeal is disposed of in terms of the settlement placed on 1/2

SA 436 23.odt record by the parties. The judgments and decrees passed by the Courts below shall be substituted by the terms of settlement. Those settlement shall be part of decree. Decree be drawn accordingly. 4.

Civil Application application No. 9506/2025 is allowed. 5.

As the Second Appeal is disposed of, Civil Application No. 12293/2023 for injunction does not survive, hence disposed of. ( SHAILESH P. BRAHME, J.) mkd/- 2/2
