17.02.2025 P.C.:- 1] Heard learned counsel for the applicant and the learned APP for the respondent-State.

2] The applicant is apprehending arrest in connection with FIR No.0274/2024 dated 11.04.2024 registered at Nandurbar City Police Station, District Nandurbar, for the offences punishable under sections 3 and 7 of the Essential Commodities Act, 1955. 3] This Court by order dated 06.05.2024, granted interim protection to the applicant. The learned counsel for the applicant submits that the applicant has cooperated with the investigation. He further submits that there is nothing to be recovered from him. He submits that the charge-sheet in the matter is also filed during the pendency of this application. The allegation against the applicant is that he has misappropriated 4 quintal 39 kgs of the rise, which was meant to be disbursed to the ration card holders. Considering that the investigation is completed in the matter and the charge-sheet is also filed, further custody of the applicant would not be required. The Tauseef

51-ABA.724.2024 trial would take substantial time to complete the same. 4] In view of the above, the application is allowed and interim protection granted by this Court on 06.05.2024 is confirmed on the following terms :

i] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.

ii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 5] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 6] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 7] The application stands disposed of.
