Heard the learned counsel for the applicant and learned APP for the respondent/State.

It has been argued by the learned counsel for the applicant that, the applicant has been arraigned as accused only on suspicion and on the statement of co-accused that he is a partner in the illegal manufacturing of foreign liquor. The raid was taken and so-called material has also been seized by the police. The coaccused released on bail. Nothing is to be recovered from the applicant. There is no antecedent to the discredit of the applicant. He is ready to cooperate with the investigation. Hence, he may be protected.

Learned APP for respondent has a strong objection that the custodial interrogation is required to know as to how many persons linked with the applicant-accused and is there any link of other persons involved in the illegal business. 4.
The record reveals that on secret information, the police have taken the raid and seized so-called raw material of manufacturing the foreign liquor. The fact does not reveal that the applicant's custodial interrogation is essential. Hence, the application deserve to be allowed. Hence, the following order - i) The application is allowed.
ii) In the event of arrest, the applicant Amol Vasant Bhoi be released on bail on furnishing P.B. and S.B. of Rs.15,000/- (Rupees Fifteen Thousand) with one solvent surety of the like amount, in C.R.No. 17 of 2022, registered with Muktainagar Police Station, Muktainagar, District Jalgaon, for the offence punishable under Section 328, 420 of the Indian Penal Code and Section 65(e) of the Maharashtra Prohibition Act; on the condition that the applicant shall attend the police station as and when called by the Investigating Officer on written notice.
iii) Bail before the trial Court.
