Heard learned counsel for appearing parties.

On instructions, learned counsel for respondent no. 2 states that proposals of petitioners no. 4 and 6 would be considered in accordance with the observations of division bench of this court in its order dated 28-07-2014 in writ petition no. 5117 of 2010 reading, thus, " 8] We have considered the contentions advanced by the learned counsel for the respective parties. If the petitioners have become eligible for the career advancement benefit and promotion for the post of Professor, prior to 21st February, 2002, then, the circular dated 21st February, 2002 would not be applicable. Said fact is clear from the letter dated 5th November, 2003, issued by the Indian Council of Agricultural Research, wherein, it is specifically stated that the modified procedure
2 WP-5765-2017 shall come into force w.e.f. 23.6.2003 i.e. the date of issuance of those instructions by the Council. The case of Scientists/Teachers who become eligible for promotion on or after this date, shall be processed as per the revised procedure. Those who become eligible prior to said date, would be governed by the procedure and the criteria as was existing on the said date."

Learned counsel for petitioners requests for indulgence to submit certain documents with university, for transmission to respondent no. 2. Documents would be submitted within a fortnight by petitioner with the university.

It is hoped that the proposals of petitioners no. 4 and 6 would be processed as expeditiously as possible, looking at that it is a matter of retired employees.

Writ petition is disposed of accordingly.
