During the course of hearing, it came to light that the petitioners have been constrained to move Civil Application No.5270 of 2025, seeking permission to serve respondents Nos.5 and 6 by alternate modes of service and if necessary through publication. rrd 1/2

The cause title shows that respondents No.5 and 6 are stated to be residents of Aurangabad (now Chhatrapati Sambhajinagar). In that light, the learned counsel for the petitioners seeks appropriate directions in the said civil application.

We find that even respondents Nos.2, 3 and 4 have not been served, who are the borrower and guarantors in the present case. 4.
At this stage, the learned counsel for the petitioners, on instructions, seeks permission to delete respondents Nos.2 to 4 at the risk of the petitioners. Hence, the petitioners are permitted to delete respondents Nos.2 to 4 at their own risk. Amendment be carried out within one week.

The Civil Application is disposed of by permitting the petitioners to serve respondents No.5 and 6 through publication. The notice shall be shown as returnable on 18th September 2025. 6.
The notice shall be published in one Hindi and one English newspaper having wide circulation in Chhatrapati Sambhajinagar. 7.
Proof of such publications be placed on record with an affidavit before the next date of hearing.
