IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 6299 OF 2018 Siddheshwar s/o Janardan Kharat Petitioner

Versus

The State of Maharashtra & others Respondents Mr. S.R. Andhale, advocate for petitioner.

Mr. S.M. Gavhane, A.G.P. for respondent no. 1. CORAM : R.M.BORDE & A.M. DHAVALE, JJ.

DATE : 25th JUNE, 2018 PER COURT:

1.

Petitioner is praying for taking action against the officials of Zilla Parishad who are responsible for causing delay in making payment of amount to petitioner under MREGS Scheme. 2.

We have perused the order passed by the Honourable Lokayukta. Delay caused appears to be of one month and twenty four days. The Honourable Lokayukta has also directed initiation of certain action against the Gram Sewak and the Accounts Officer. Petitioner contends that action is also required to be taken against the higher authorities.

3.

In our view, considering the grievance raised as well as after going through the order passed by the Honourable Lokayukta, there does not appear to be any sufficient reason to cause interference under extra ordinary jurisdiction under Article 226 of

{2} wp6299-18.odt the Constitution of India. Petitioner has already received the benefits legally receivable by him. Delay that has been attributed is also merely of one month and twenty four days. There is no substance in the writ petition. Petition as such stands rejected. A.M.DHAVALE R.M.BORDE JUDGE JUDGE dyb
