Learned counsel for the petitioner assures that in any case by Tuesday i. e. 02nd May, 2023 appeal shall be lodged before the Debt Recovery Appellate Tribunal, Mumbai (for short D.R.A.T.) against the order impugned in the present petition. He submits that till the appeal is lodged and heard, this Court may direct the parties hereto to maintain status quo.

He would try to prevail upon factual matrix of non availability of Presiding Officer of D.R.A.T so as to take up his appeal, which is likely to be filed for hearing.

The fact remains that Presiding Officer of D.R.A.T. Mumbai is now available and petitioner has made a statement that it shall be lodging appeal in any case on 02nd May, 2023. In this background, we deem it appropriate to dispose of the petition by directing the D.R.A.T. Mumbai to stay its hands for a period upto 04th May, 2023.
