PER COURT:

This petition seeks direction to the respondent No.2 to transfer the investigation to some other police officer from the present investigating officer. There is also prayer to register FIR against Gopichand Dattu Limbalkar, Mesaji Pandit Kawale and Narsing Sakharam Kawale for committing the murder of deceased Uttam Bansode. 2] We have heard the counsel for the petitioner and learned APP for the State. We have also perused the investigation papers. In our opinion, without entering into the merits of the contentions raised in the petition, ends of justice would be met, if the Superintendent of Police, Latur is directed to look into the grievance of the petitioners, and after summoning the investigation papers, take appropriate decision about the grievance raised by the petitioners in this petition. 3] The petitioners will be at liberty to file copy of this petition, with annexures thereto, in the Inward Section at the office of the Superintendent of Police, Latur.

{2} 926 sr.no..odt 4] The Superintendent of Police, Latur can consider the pleadings in the petition and also annexures thereto, before taking the decision. The Superintendent of Police, Latur, shall take appropriate decision about the grievance of the petitioners , in accordance with law, as expeditiously as possible, however, within four weeks from the date of receipt of copy of this order.

3] Learned APP assures this court that copy of the order of this court will be sent to the office of the Superintendent of police, by fastest mode of communication, through the office of the Additional Public Prosecutor at this Bench.

4] Criminal writ petition is disposed of. Parties to act upon authenticated copy of this order.
