This is an application on behalf of applicant Nos.2 and 3 for permission to withdraw their shares of the deposited amount of 50%. It is pointed out that, by order dated 14/11/2024 in this appeal on Civil Application No.1732/2024, this Court had permitted applicant Nos.1, 4 and 5 to withdraw 50% amount of their share alongwith accrued interest on furnishing usual undertaking. Similar request is made with respect to shares of applicant Nos.2 and 3 herein. 2.

Learned counsel for respondent/sole points out that applicant No.3 Saurav Narendra More is minor, and therefore, requests

5295.25ca (2) for applicant No.2 Gaurav Narendra More can be considered at this stage.

In view of this, the civil application is partly allowed. Applicant No.2/Gaurav Narendra More is permitted to withdraw 50% amount of his share alongwith accrued interest on furnishing usual undertaking. Further 25% amount of his share alongwith accrued interest is permitted to be withdrawn on furnishing solvent surety/security to the satisfaction of the learned Registrar (Judicial) of this Court. The remaining amount be deposited in the Fixed Deposit in any of the Nationalized Bank till disposal of the appeal. 4.

Civil application is disposed of.
