None present for the State. The present First Appeal is filed by the State and as per the earlier order dated 28.02.2023 passed by this Court, it was directed to bring the legal heirs of sole respondent i.e. Baburao Devrao Langote, on record as intimation given by the learned Advocate for the respondent, about the death of Baburao Devrao Langote.

Upon perusal of record, it appears that previously on 28.02.2023, two weeks time was granted to the State to take necessary steps to bring on record the legal heirs of sole respondent. 3.

Earlier this Court has vide order dated 31.01.2023, granted four weeks time as per the request made by the 120 FIRST APPEAL NO.1314 OF 2003

representative of Government Pleader, which was again vide order dated 28.02.2023 extended for two more weeks time. However, the State authorities have failed to take necessary steps to bring on record the legal heirs of deceased sole respondent. 4.

In view of the above stated facts, the Appeal needs to be dismissed against deceased sole respondent and the same is dismissed accordingly. Hence order.

ORDER

The First Appeal stands dismissed against sole respondent for want of prosecution by virtue of the powers conferred upon Registrar vide provisions under Chapter VII Rule 6(1) (d) (e) of the Bombay High Court Appellate Side Rules, 1960. REGISTRAR (JUDL) 120 FIRST APPEAL NO.1314 OF 2003
