Heard learned Counsel for the applicant - wife. The respondent husband, though served, but remained absent. 2.

The applicant - wife is seeking transfer of HMP No. 29/2023 pending in the Court of Civil Judge (Senior Division), Parbhani filed by respondent - husband for getting divorce, to the Court of Civil Judge (Senior Division), Ambejogai, District Beed.

According to the applicant-wife, she is not having any independent source of income and she is also maintaining three years son without any financial aid from respondent husband. Moreover, she has also filed proceeding under Section 9 of Hindu Marriage Act against the respondent - husband. There is no oppose to the present application. Further, the respondent will have to attend the dates at

(2) 955 MCA-137.2023.odt Ambejogai in the proceeding filed by the applicant. As such, considering the convenience of applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) HMP No.29/2023 pending in the Court of Civil Judge (Senior Division), Parbhani is transferred to the Court of Civil Judge (Senior Division), Ambejogai, District Beed for disposal according to law.

(iii) The respondent is directed to appear before the learned Civil Judge (Senior Division), Ambejogai on or before 01.08.2023..

(iv) The application is disposed of accordingly.
