CORAM

: PRAFULLA S. KHUBALKAR, J.

DATE : 08.07.2025 PER COURT :- 1.

Heard rival submissions. The respective applicants are seeking withdrawal of their respective amounts of compensation alongwith the interest accrued thereon which have been deposited by the respondents. 2.

The learned counsel for the applicants submits that the Reference Court has granted enhancement four times than the SLAO. The learned

( 2 ) 946 CA 5928 OF 2025 counsel for the respondents also accepted the same, but insisted for withdrawal of only 75% of the deposited amounts. However, it appears that the compensation amounts are meager amounts.

3.

The learned counsel for the applicants submits that the amounts sought to be withdrawn are Rs.1,30,234/- in Civil Application No.5928 of 2025, Rs.2,14,260/- in Civil Application No.5929 of 2025 and Rs.1,46,984/- in Civil Application No.5930 of 2025. He also submits that, in a similar matter arising out of the same project, this Court has permitted withdrawal of the amounts by order dated 3rd May 2023 in Civil Application No.3613 of 2023 in FAST/35229/2021 with connected matters and prays for similar orders. 4.

In view of this, present applicants are permitted to withdraw their entire respective deposited compensation amounts alongwith the interest accrued thereon till date, on usual undertaking to the satisfaction of the Registrar (Judicial) of this Court, stating therein that in case the appeals are decided and the claimants/applicants are required to deposit the amounts, they will redeposit the amounts immediately.

5.

The Civil Applications are accordingly disposed of. ( PRAFULLA S. KHUBALKAR, J. ) PRW
