Mr. Borde, learned counsel holding for Mr. Dhananjay P. Deshpande, learned counsel for the appellant/Insurance Company along with representative of the appellant/Insurance Company namely Mr. Dhammanand Sonwane are present today. 3.

The learned counsel for the appellant/insurance company has tendered written instructions to withdraw the appeal. Same is taken on record and marked 'X' for identification. 4.

In view of the written instructions and the submission

2 fa st 455.15 made by the learned counsel for the appellant, the first appeal stands disposed of as withdrawn.

The amount deposited in this Court if not withdrawn shall be allowed to be withdrawn by the respondent/claimant along with accrued interest. The appellant further undertakes to deposit balance amount before the M.A.C.T. Parbhani within a period of eight (08) weeks from today. On depositing the amount, the respondent/claimant shall be at liberty to withdraw the same. The amount deposited in this Court and if same is not withdrawn by the respondent/claimant, shall be transmitted to the M. A. C. T. Parbhani.

The court fees be refunded as per rules.

Award be drawn up accordingly.
