The present application has been filed for condonation of delay of 40 days caused in filing the application for restoration and to restore the criminal application No. 3529 of 2023. 2.

Learned A.P.P. as well as learned advocate for respondent No.2 waive notice.

On 3.2.2025, a conditional order came to be passed that the learned advocate for the applicant was absent and he has not removed the office objections and therefore, time was granted to remove the office objections till 14.2.2025 and in case of failure, the

cran1492.25 -2application was to be treated as dismissed automatically without reference to the Court. It appears that learned advocate had not removed the office objections and therefore, conditional order came into existence. Learned advocate for the applicant is how ready to remove the office objections and therefore, the application stands allowed. Delay has been condoned subject to deposit of costs of Rs.1,000/- to the High Court Legal Services Authority, Aurangabad, within a period of one week. The criminal application No. 3529 of 2023 stands restored.

The applicant to remove the office objections within a period of one week. Place the criminal application No. 3529 of 2023 for further consideration on 29.07.2025, if the above conditions are fulfilled.
