After hearing the learned Counsel for the petitioner, who has questioned an order of condonation of delay, passed by the District Superintendent of Records, Ahmednagar, it is noticed that the limitation prescribed for preferring an appeal is 60 days and the proceedings are initiated perhaps after the delay of ten months. 2.

In my opinion, the discretion exercised by the said authority while ordering condonation of delay is just and proper, however, the order condoning the delay is hereby modified and all the appellants therein are directed to pay costs of Rs.1,000/- to each of the respondent within a period of three weeks from today before the said authority.

Petition stands allowed in above terms.
