Heard Mr. D.P. Palodkar, learned Advocate for the petitioner, Mr. S.B. Rajebhosale, learned Advocate for the applicant/intervenor, as also Mr. P.R. Nangare, learned Advocate for respondent Nos.4 and 5. 2.

Pursuant to the submissions made at the bar, it appears that the Writ Petition arises out of an order of the Minister directing reinstatement of the Sarpanch disqulified pursuant to an order under Section 39(3) of the Maharashtra Village Panchayats Act, 1958. 3.

The parties are unanimous that by passage of time, a new body has come in the office and consequently, the cause of action does not survive against the new body. Since the Writ Petition has now become

CA7750-2021 infructuous, it is disposed of. In view of disposal of the Writ Petition, pending Civil Application No.7750/2021 is disposed of. 4.
