This application has been filed in a disposed of First Appeal. Appeal filed by the Insurance Company has been dismissed on merits but legal heirs of respondent n. 5 Dattatraya Marotirao Lashkare remained to be brought on record.

The death certificate and the affidavits filed on record indicate that respondent no. 5 Dattatraya is survived by respondent no. 4 Padminbai and respondent no. 5/1, 5/2 and 5/3 shown in the title clause of the application. They are entitled to receive the amount with accrued interest. However, there is consensus amongst the legal heirs that amount should be disbursed to respondent no. 4 Padminbai. There is no reason to doubt the consensus arrived at by the claimants.
