Heard learned Counsel for petitioner and learned Assistant Government Pleader for respondents No.2 to 4. 2.

The Appellate Court has condoned delay and has also granted interim relief during pendency of appeal filed by defendant/respondent No.1 against the decree of possession by the Trial Court. As such, it may not be proper to intercept the order at this juncture. In the circumstances, the Appellate Court may proceed with the appeal and dispose it of as early as possible, preferably within a period of nine months from the date of receipt of writ of this order.
