PER COURT:

1] The grievance raised by the petitioner in the instant petition relates to alleged financial indiscipline/irregularities by the Municipal Corporation, Ahmednagar. According to petitioner, funds which have been deposited with the Corporation for a particular purpose by the Reliance Industries, have not been utilized and the same amount is shown to be the deposit on behalf of the Corporation for securing funds from the State Government, of its share. It is pointed out that in an affidavit presented to this Court, it is averred on behalf of the Municipal Corporation that certain works have already been commenced by utilizing the funds deposited by the Reliance Industries. It is contended by the petitioner that either the stand taken by the Corporation in the affidavit presented to this court may be false or the representation made to the State Government in respect of availability of the funds is misleading.

2] Since disputed questions of fact are raised in the petition we deem it appropriate to direct the petitioner to approach the State Government for redressal of his grievance. It would be open for the

{2} PIL 67.16.odt petitioner to tender appropriate representation to the Principal Secretary, Urban Development Department, who shall take appropriate decision on it in accordance with law, expeditiously.

3] With these observations, PIL stands disposed of. While entertaining the petition, the petitioner was directed to deposit a sum of Rs. 10,000/- in this Court.
