It is submitted that, the petitioner was granted permission to lift the seized 36 bras of sand under order dated 01.01.2016. The petitioner had deposited an amount of Rs. 2,20,000/-, however, the petitioner is not allowed to lift the sand. From time to time representations are made. Neither the petitioner is allowed to lift the sand, nor he is allowed refund of the amount. The petitioner has made communications from time to time. Even Tahsildar has communicated with the Collector, however, no decision has been taken on it as yet.

The Collector shall take decision about claim of the

2 wp 5147.18 petitioner for refund of the amount and/or for lifting the sand (Exhibit - G) as may be permissible in law, expeditiously and preferably within a period of two (02) months from today. 3.

The writ petition is disposed of. No costs.

The learned A. G. P. shall communicate this order to the concerned Collector.
