Present application has been filed for withdrawal of the amount. Amount of Rs.6,26,526/- has been deposited in this Court. 2.

Learned Advocate appearing for the insurance companyrespondent No.1 has strong objection to allow the application. It has been submitted that the award has been passed on higher side. 3.

Taking into consideration the contents of the judgment and the fact that, case is made out for partial withdrawal of the amount. Applicant is allowed to withdraw the amount of Rs.3,00,000/-. Rest of the amount be invested in fixed deposit.

Applicant to file an undertaking within a period of eight weeks that he would make the said amount good, if directed at the time of final disposal of the appeal.
