Heard the learned Advocate for the Applicant and the learned APP for the State. Perused the papers. 2.

The Applicant is shown as Accused No. 9 in the FIR bearing Crime No. 0027 of 2025 registered with Shrigonda Police Station, District Ahilyanagar, for offences punishable under Sections 419, 420, 467, 468, 471 r/w 34 of the Indian Penal Code, 1860. Since his Application is rejected by the learned Sessions Court, he has approached this Court by way of the present Application. 3.

The aforesaid Crime is registered on the report lodged by one Popat Laxman Sonawane, who was the owner of land being Gut No. 214, ad measuring 2 Hector 49 Are, situated at Chikhali, Tal. Shrigonda. The said land was sold by the Applicant by impersonation. The sale

Though the Sale Deed was executed by the Applicant on 16.12.2009, the report is lodged on 10.01.2024. Before the Crime was registered and when the Informant had lodged the Complaint and the Applicant was apprehending arrest, the Applicant filed the Application being Cri. (Bail) Misc. Appln. No. 140 of 2024 before the learned Additional Sessions Judge, Shrigonda for anticipatory bail in which the following order was passed :

"ORDER (1) The application is partly allowed.

(2) The Incharge of Police Station Shrigonda is hereby directed not to take any harsh step like arrest against the applicant within 24 hours after offence is registered against him pertaining to this matter so as applicant ... file anticipatory bail application before appropriate Court.

(3) The applicant is hereby directed to cooperate the Investigating Officer in the inquiry by going to police station during 10.00 a.m. to 12.00 noon on 1st and 3rd Saturday till further order.

Pursuant to the said protection, the Applicant joined the investigation. It is after the Crime was registered, the Criminal (Bail) M.A. No. 137 of 2025 was filed by the Applicant before the said Court, which came to be rejected by order dated 03.03.2025. The papers on record show that the documents in the Crime are with the Investigation

3 938ABA709.2025.odt Officer. Considering these aspects of the matter and that the Investigation is almost complete, the Application can be allowed on certain conditions. Hence, I pass the following order : -

ORDER

[i] The Application is allowed.

[ii] In the event of arrest of the Applicant, Baliram Shankarrao Kakade, in connection with Crime No. 0027 of 2025 registered with Shrigonda Police Station, District Ahilyanagar, for offences punishable under Sections 419, 420, 467, 468, 471 r/w 34 of the Indian Penal Code, 1860, he be released on bail on his furnishing P.B. of Rs. 30,000/- [Rupees Thirty Thousand], with one or two sureties in the like amount.

[iii] The Applicant shall attend Shrigonda Police Station, District Ahilyanagar, as and when called.

[iv] The Applicant shall co-operate with the Investigating Agency.

[v] The Applicant shall not change the place of his residence without intimating the concerned Police Station. [vi] The Application stands disposed off.
