IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO.6499 OF 2014 IN SECOND APPEAL NO.378 OF 2014 Vishal Vijay Bokadiya APPLICANT

VERSUS

Shaikh Noor Mohammad s/o Osman Bhai & Anr. RESPONDENTS .......

Mr. Anil H. Kasliwal, Advocate for the applicant Mr. L. B. Palod, Advocate for respondent No.1. .......

[CORAM : SUNIL P. DESHMUKH, J.] DATE : 28 th NOVEMBER, 2016 ORDER :

1.

Heard learned advocates for the parties.

2.

Although earlier on interim relief had been granted in terms of prayer clause "B", after hearing learned advocates for the parties it appears that both the courts have concurrently considered the plaintiff to be in possession of the property and as such, interim relief in terms of prayer clause "B" may not be necessary to be continued. However, in the facts and circumstances of the case, interim relief in terms of prayer clause "C" stands granted.

3.

Civil application stands disposed of accordingly. [SUNIL P. DESHMUKH, J.] drp/ca6499-14
