The learned senior advocate Mr. Mandlik for the petitioner submits that the petitioner is claiming grant in aid and has been demonstrating the discriminatory treatment meted out to its B.Ed. college. He would submit that the petitioner's college was established in the year 1990 and since then it is awaiting grant in aid. Many colleges established thereafter have been granted grant in aid. Even the petitioner's Law College has been held to be entitled to grant in aid pursuant to the order passed in Writ Petition No. 969/2004. He submits that at the moment the petitioner would be satisfied if a direction is given to the respondents to consider its proposal for receiving grant-in-aid on its own merits.

Considering the fact that the petition contains particulars about the colleges which were granted grant in aid though established subsequent to its college and that too even after the policy of the year 2001, the request is clearly innocuous and can be directed to be considered on its own merits. 6.

We dispose of the writ petition by directing the petitioner to file a fresh proposal addressed to the concerned department which shall be considered on its own merits, as expeditiously as possible, and in any case within twelve weeks from receipt of the fresh proposal.
