Pursuant to various orders passed by this Court, the Mamlatdar has finally decided the proceedings under Section 5 of the Mamlatdar Courts Act, 1906, vide order dated 19th October, 2022. The application preferred by the petitioners has been allowed. The obstruction has been identified. Pursuant to the final order, the Mamlatdar has granted 60 days time to the non applicants to remove the obstruction, failing which the authorities would initiate the exercise of removal of obstruction.

The learned AGP submits that 60 days time has been granted by the Mamlatdar to the non applicants to approach the revisional authority under Section 23(2).

We would not comment upon the further litigation journey in between the parties.

This petition is therefore, disposed off.

Nevertheless, if within 60 days, no revision is filed or if there is no order passed by the revisional authority on the revision that is filed, the competent authority shall immediately initiate steps for removal of obstruction in the light of the order of the Mamlatdar dated 19th October, 2022.
