This is the Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') for Anticipatory Bail in Crime No.0047/2025 registered with Shivoor Police Station, Dist. Chhatrapati Sambhajinagar (Rural) for the offences punishable under Sections 109, 115, 352, 351(2), 351(3), 324(4), 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS'). 2.

Heard the learned Advocate for the Applicant and the learned APP for the State. Perused the papers on record. 3.

It is the case of the Prosecution that, on 18.01.2025 the Co-accused - Nitin Shelar demanded extortion money from the Informant. The Informant lodged report against the said Nitin Shelar in respect of the said incident. Therefore, Nitin Shelar had grudge against the Informant. On 22.02.2025 in the evening around 06:30 p.m., the Informant went to the Anand Beer Bar where the Applicant and

Co-accused were already present. Altercation took place between the Informant and the Accused persons. The Informant was assaulted by all the Accused persons. The broken Bottle was used in the assault by the Co-accused - Nitin Shelar. As the incident was reported to the Police, the aforesaid Crime came to be registered.

Though it is the contention of the learned APP that, the transcript of the CCTV footage of the said beer bar shows that the Applicant was holding the broken bottle, the Informant in his Report nowhere attributes the role of assault by the broken bottle to the Applicant. The medical papers show that the injuries suffered by the Informant were simple in nature. All the Co-accused are released by the learned Sessions Court. The investigation is almost over. The Applicant was protected by interim order dated 07.05.2025 on certain conditions. It is nobodies case that the Applicant flouted any of the conditions. Considering these aspects, I am inclined to confirm the Interim Protection granted to the Applicant. Hence, the following order:

ORDER

i) The Interim Order dated 07.05.2025 is confirmed. ii) The Application stands disposed off.
