Heard learned counsel for the applicant. The respondent despite service, remained absent.

The applicant is seeking transfer of HMP No.63 of 2021 fled by respondent husband for getting divorce, from the Court of CJSD Barshi to CJSD, Nanded.

According to the applicant, she is not having any independent source of income and she has also fled criminal prosecution against the respondent under Section 498A of IPC at Tamsma Police Station, Taluka Hadgaon, District Nanded. Thus, it appears that since the respondent will have to attend the dates of the aforesaid criminal prosecution at Nanded, proceeding fled by him at Barshi can be conveniently transferred as prayed by the applicant. Hence, following order.

ORDER

(i) The application is hereby allowed.

2 966 mca 135-21 (ii) The HMP No. 63 of 2021 pending in the court CJSD Barshi is transferred to CJSD, Nanded for disposal according to law.

(iii) The respondent is directed to appear before the Civil Judge S.D., Nanded on or before 25/01/2023.
