Instant application is for relaxation of condition no.(b) of clause no.(ii) imposed by this Court by order dated 08-04-2025 passed in Bail Application No.438 of 2025.

Learned counsel pointed out that after registration of crime bearing no.126 of 2025, applicant was arrested. That, applicant applied for bail and the same was granted by this Court by imposing conditions. He further submitted that applicant has huge agricultural land and that is his occupation. That, except him, no one is there to look after his land. That, now Monsoon is advancing. That, he has also to look after business of Tractor Agency. That, both his business activities are affected because of condition no.(b) of clause no.(ii) i.e.

{2} CR APPLICATION NO. 1502 OF 2025 "The applicant shall not leave the area of jurisdiction of the concerned police station till conclusion of trial". Learned counsel undertakes that he will not misuse liberty and he will not indulge in any adverse activities.

Learned APP opposed application on the ground that there is specific condition in view of nature of charge. However, he fairly concedes that chargesheet is filed and case is committed. 4.

After considering the above submissions, when case is committed, there are now immediate prospects of matter going for trial. Therefore, condition no.(b) of clause no.(ii) is required to be relaxed subject to furnishing undertaking that applicant will not misuse liberty and he will not use any pressure tactics on witness and complainant.

Application is allowed. Condition no.(b) of clause no.(ii)of order dated 08-04-2025 passed in Bail Application No.438 of 2025 is hereby relaxed.
