1] Heard. The grievance of the petitioner is that the Commissioner does not have any jurisdiction to deal with the proceedings initiated by the Commissioner. Notice dated 7.10.2015 issued by the Commissioner, according to petitioner, is void-ab-initio and without jurisdiction.

2] learned counsel for the respondent No.2, on instruction from respondent No.2, makes a statement that the respondent No.2 would decide the objection of the petitioner with regard to jurisdiction of Commissioner, first.
