This application is filed for withdrawal of the amount deposited by the appellant/Acquiring Body in this Court pursuant to the judgment and award passed by the learned Reference Court.

The applicant is the Claimant whose land is acquired for project. Learned Advocate for the applicant has produced alongwith the Civil Application the copies of the earlier order

903ca5582.24 withdrawal passed by this Court in group of the similar matters in Civil Application No. 3613 of 2023 in FAST No. 35229 of 2021. 3.

In view of the above submissions this Court has permitted the applicant therein to withdraw the entire amount. In view of this, this Court inclined to pass the following order :

ORDER

a) The Civil Application is allowed and disposed off.

b) The applicant is entitled to withdraw the entire amount deposited in this Court alongwith accrued interest on furnishing usual undertaking that in case the appeal is allowed the applicant shall re-deposit the whole amount in this Court. ( KISHORE C. SANT ) JUDGE mahajansb/
