Leave to amend cause title with regard to Respondent No.2.

It is submitted that the caste certificate of the petitioner is referred to the Committee for validation in the year 2016. The

2 W.P.No.5592/17 same is still pending. The Respondent No.3 has issued letter to submit the validity certificate, else admission would be cancelled.

We have heard learned Additional Government Pleader for Respondent Nos.1 and 2. 4.

Respondent Nos.3 and 4 though served, none appears for Respondent Nos.3 and 4.

To get the proceedings decided within the stipulated period is not in the hands of litigant. This Court under order dated 26.4.2017 has stayed the effect of the letter dated 3.4.2017.

Considering above, we pass the following order :

a) The impugned letter dated 3.4.2017 (Exh.F) is quashed and set aside.

b) The Committee shall decide the validation proceedings in respect of the tribe

3 W.P.No.5592/17 claim of the petitioner expeditiously, preferably within nine (9) months. The petitioner shall cooperate in expeditious disposal of the said proceedings.

c) The Respondents can take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceedings. So also Respondent Nos.3 and 4 shall not issue any degree certificate till the validation proceedings are decided.

d) The Writ Petition is disposed of. No costs.
