This Petition is filed for seeking implementation of the order dated 22.05.2023 passed in Second Appeal No. 535/2023, by the State Information Commission, Aurangabad. 2.

We are informed that Writ Petition Nos. 9956/2023 and 629/2024 have already been filed for challenging the same order. Since the order is passed by a quasi judicial authority, both the Petitions are pending before the learned Single Judge.

Firstly, in the light of the above, this Court would not issue a Writ of Mandamus for implementation of the order which is already sub-judice before the learned Single Judge. Secondly, clause No. 2 of the impugned order indicates that the State Information Commissioner, Aurangabad has already initiated action under Sections 19(8)(g) and 20(1) of the Right to Information Act, for ensuring compliance of the order.

In view of the above, this Writ Petition is disposed off. Needless to state, disposal of this Petition would not come in the way of the present Petitioner in agitating his claim before the learned Single Judge, since he is a Respondent in the said proceeding.
