The matter was on board on 12.09.2022. The Court has asked the query to the learned advocate as to whether the application is maintainable and was directed to address the Court on maintainability of the application.

Today when the matter is called out, at the outset, the learned advocate very fairly submitted that the application is not maintainable. There is no provision to file such application. He submits that the present application is not maintainable in view of Section 362 of the Code of Criminal Procedure.

In view of this submission, the application is dismissed as not maintainable.
