Learned Counsel for the Petitioner makes statement that Special Civil Suit No. 17/2018 (Old No. 23/14) has been partly decreed. It is thus his contention that present Petition has become infructuous as the same was filed to challenge order passed below Exh. 39 dated 13.01.2021. He seeks liberty to take exception to the said order while filing Appeal against judgment and decree.

Petition is disposed of as withdrawn. If it is legally permissible for the Petitioner to take exception to the impugned order herein in any other proceedings, he is permitted to do so.
