Applicant who is a lady is the Ex-Sarpanch of village Ambulga (V), Tq. Nilanga, Dist. Latur. It is alleged in the First Information Report that she along with co-accused who is Gram Sewak mis-appropriated sum of Rs. 1,20,000/- by creating bogus record in respect of Clean India Scheme. It is alleged that without constructing the toilets, it was shown that they were constructed and the amount received for that purpose was mis-appropriated. 2.

It is not in dispute that there is allegation of misappropriation of Rs. 1,20,000/- and the said amount is already deposited by the applicant. The documents concerning this crime

- 2 - aba617.23.odt are with the concerned offce. Nothing is to be recovered from the applicant. Hence, application is allowed in terms of interim order. It is clarifed that the amount deposited would be subject to the outcome of the trial.
