The limited grievance of the Petitioner is that though a failure report dated 28.09.2020 has been forwarded by the Conciliation Officer under the Industrial Disputes Act, 1947 (Central) to the Secretary, Government of India, Ministry of Labour and Employment, further orders have not been issued by the competent authority, which has to decide as to whether the dispute needs to be referred to the competent Court for adjudication.

There is no dispute that, the Industrial Dispute raised by the Petitioner with regard to his termination, is presently subject matter of adjudication before the Labour Court. 3.

In view of the above, this Petition is disposed off with a direction to Respondent No.1 to take a decision on the failure report within 45 days from today and pass appropriate orders. A compliance report shall be placed before us within a period of 15 days thereafter. 4.

Needless to state, this order would operate if no decision has been arrived at. If the decision has already been arrived at, the said decision shall be communicated to the Petitioner on the address mentioned in the clause title in this Petition, within 15 days. [ Y. G.
