The petitioner is seeking premature release under the policies of the State government.

A proposal was forwarded by the respondent no. 2 - jail authority to the State government - respondent no. 1 on 07-09-2022 ex facie pointing out the views of the trial court under section 432 of the Code of Criminal Procedure.

If such is the state-of-affairs, one wonders why the proposal has been kept pending for last so many months. If it would have been accepted timely, in all probability, the petitioner would have been out of jail.

We dispose of the writ petition by directing the respondent no. 1 to take decision on the petitioner's proposal received by it from the respondent no. 2 - Superintendent, Visapur District Open Prison, Vill - Visapur as expeditiously as possible and in any event within two weeks.
