Heard the learned Advocate for the applicant. 2.

Inspite of service, none appears for the respondent. 3.

This application is filed at the instance of the applicant-wife seeking transfer of matrimonial proceeding bearing Marriage Petition No.56 of 2024 from the Court of learned Civil Judge, Senior Division, Ambad Dist. Jalna to the Court of learned Civil Judge, Senior Division, Majalgaon Dist. Beed.

It is the case of the applicant-wife that she is residing with her parents. The distance between two places is around 101 k.m. There is no

( 2 ) one to accompany her to travel to Ambad to attend the court proceeding. By now, it is well settled position that, in the matters of transfer of the proceedings, the convenience of the wife should be seen. In the present case, inspite of notice, none has appeared for the respondent. This Court, therefore, believes that the respondent has no serious objection to grant the prayers made in this application. 5.

Considering above, following order:

ORDER

(i) Misc. Civil Application stands allowed.

(ii) The proceedings of of Marriage Petition No.56 of 2024 pending before the Court of learned Civil Judge, Senior Division, Ambad Dist. Jalna stands transferred to the Court of learned Civil Judge, Senior Division, Majalgaon Dist. Beed.

(iii) After transfer of the proceeding, the applicant shall not seek unnecessary adjournments. In case the Trial Court finds that the adjournments are unnecessarily sought, the Trial Court may deal with such application, so as to compensate the respondent-husband, if he

( 3 ) personally remains present.

(iv) Whenever request is made by the respondent-husband seeking permission to appear through video conferencing, the same shall be considered liberally by the trial Court.
