The applicants are seeking pre-arrest bail in Crime no. 80 of 2016 registered at Partur Police Station, Dist. Jalna for the offences punishable under section 420, 467, 468, 471, 472 r/w. 34 of the Indian Penal Code.

Pursuant to an order passed under section 156(3) of the Code of Criminal Procedure, crime

2 Cri. Appln. 2468-2016 no.80 of 2016 came to be registered against the applicants for the alleged incidents dated 22/1/2014 to 22/7/2014. The case as against the applicants is that the applicants, in connivance with the main accused, namely, Jaywant Daulatrao Jagtap of Vrudhi Developers defrauded the complainant and other persons who have deposited certain consideration in the form of deposits.

Perused the complaint and the alleged notarised deed executed on 22/7/2014 between the complainant Sanjay Rahate and Jaywant Jagtap of Vridhi Developers. The applicants are no way concerned with the transaction in question. Even in the complaint, it is alleged that the complainant has paid an amount of consideration to the accused no.1.

It is claimed that the present applicants were working with accused no.1 - Jaywant Jagtap. Prima faice, the involvement of the applicants in

3 Cri. Appln. 2468-2016 the commission of crime in question could not be inferred from the investigation papers. Hence, the following order :- 6.

In the event of the arrest of the applicants in Crime no.80 of 2016 registered with Partur Police Station, Dist. Jalna for the offences punishable under section 420, 467, 468, 471, 472 r/w. 34 of the Indian Penal Code, they be released on bail upon their executing P.R. bonds in the sum of Rs.15,000/- (Rs. Fifteen Thousand) each with one surety each in the like amount.

The applicants shall attend the concerned Police Station on 25th and 26th June, 2016 between 10 am and 12 noon and thereafter as and when called. 8.

Criminal Application stands disposed of accordingly.
