Smt. Dube, the learned counsel for the Respondent No. 2 / Corporation submits that, after filing of the present petition the Petitioner gave a letter to the Respondent No. 2 / Corporation that the Petitioner is not interested and had asked for the refund of the I. D. P. of Rs. 1,50,000/- to the Petitioner. In view of the above, as the Petitioner himself has subsequently resiled and has accepted the amount of I. D. P. the Petitioner now cannot agitate the present petition.
