The petitioners claim to be the employees of the private added Ashram School and seeking the benefit in tune with the view expressed by the division bench in the matter of Kiran Namdeo Shinde and Ors. Vs. The State of Maharashtra and Ors.; Writ Petition No.2358/2013 and connected matters decided at the Principal Seat by common judgment and order dated 21.09.2013).

In the light of the above, after hearing both the sides we dispose of the writ petition directing respondents No.1 to 4 to undertake scrutiny of the entitlement of each of the petitioners whose school derive

2 908.WP.5939.25.odt the benefit of Assured Career Progress Scheme (ACPS) in the light of the decision in the matter of Kiran Namdeo Shinde (supra). The scrutiny shall be undertaken and completed within four months. 4.

Pursuant to the scrutiny if any or all of the petitioners are found entitled to derive the benefit under the scheme, the benefit shall promptly be released/extended, as expeditiously as possible within three months thereafter.
