When this Court expressed disinclination to allow the application, the learned advocate for the applicant, on instructions, seeks leave to withdraw the application. Leave granted. The application is disposed of as withdrawn.

The learned advocate for the applicant further submitted to expedite the matter. Already the matter is scheduled for recording of statement of accused under section 313 of the Criminal Procedure Code. It is submitted that many times, the accused is not produced by the Jail Authorities.

The trial Court is directed to give specific directions to the jail authorities to produce the accused. If such directions are not followed by the jail authorities, the trial court once give an opportunity

777.2024BA -2to jail authorities and escort party/police authority to produce the accused. If even after those directions, the accused is not produced, the trial Court may proceed against the concerned jail authorities and escort party by taking action against them as per the Chapter X of the Indian Penal Code for contempt of lawful authority. However, the trial court is directed to conclude the trial as early as possible and in any case on or before 30th June, 2024. Needless to mention that it is a "session case" and word "session" means, once it is started, it should not be stopped till it is concluded.
