Heard rival submissions. The applicant is seeking recalling of order dated 26.08.2019 whereby his First Appeal No. 5005 of 2017 was dismissed due to his absence. The learned Counsel for respondent No.3 though opposed the application, but considering the statutory right of the applicant and for the reasons stated in the application, the application is allowed in terms of prayer clauses (B) and (C).
