This is an application for relaxation of condition ii (c) i.e. "He should not reside in village Gaur till the trial is concluded." imposed by this Court on the applicant while granting him bail vide order dated 9th September, 2024 passed in Bail Application No.1196 of 2024. Heard the learned counsel for the parties.

Perused the application.

The learned counsel for the applicant submitted that the trial has started. However, the trial will take long period. He submitted that the applicant has no criminal antecedents. The wife of the applicant is no more and his daughter of marriageable age is residing alone in the village. The case is based on circumstantial evidence. He lastly

The learned APP for the State strongly opposed the application and submitted that the applicant is booked for serious crime of murder and the trial has not yet concluded. If the said condition is relaxed, the applicant will pressurize the prosecution witnesses and tamper with the evidence. It is lastly prayed to reject the application. Admittedly, the trial has started. It appears that the trial will take long period. The case is based on circumstantial evidence. There is no question of pressurizing the prosecution witnesses. Considering all these reasons, the application deserves to be allowed. Hence, the application is allowed in terms of prayer clause (B). Condition ii (c) i.e. "He should not reside in village Gaur till the trial is concluded." imposed by this Court on the applicant while granting him bail vide order dated 9th September, 2024 passed in Bail Application No.1196 of 2024, stands relaxed.
