Heard learned Advocate Mr Tilve for the Applicant and the learned APP Mrs Sangit for the Respondent/State.

My attention is drawn at the very outset to an order dated 09 May 2025. The Applicant has been protected by the said order inter alia by the terms and conditions, which are elaborately spelt out in paragraph No.5 of the said order. Pursuant thereto, the matter has appeared today. 3.

Mrs Sangit has taken instructions from the concerned Investigating Officer. She would submit that the Applicant has cooperated with the investigation. There is no breach or non-compliance of the order dated 09 May

( 2 ) 2025. This would mean that the Applicant has joined the investigation. There is no prima facie material placed on record by the prosecution against the Applicant after the order dated 09 May 2025. The Applicant has further undertaken to continue cooperation with the investigation. It also appears that investigation has sufficiently progressed. In such view, physical custody of the Applicant at this stage would not be necessary. Considering the given factual matrix, it would be just and proper to Confirm the Interim Order of this Court dated 09 May 2025. The following order would meet the needs of justice:-

ORDER

(i) In the event of arrest of the Applicant Shubham Pandurang Suradkar in connection with C.R. No.0001 of 2025 registered with M.I.D.C., Cidco Police Station, Dist. Chhatrapati Sambhajinagar for the offences punishable under Sections 309(5) and 3(5) B.N.S. 2023, he is directed to be released on bail on furnishing PR bond in the sum of Rs. 20,000 (Rupees Twenty Thousand Only) with one solvent surety in the like amount. (ii) The Applicant shall attend the concerned Police Station on as and when called for by the Investigating Officer until filing of the Charge-Sheet. He is further directed to co-operate the investigation.

(iii) The Applicant shall furnish details of residential address and other contact details such as the mobile number etc. to the concerned police station. If there is any change in the contact

( 3 ) details, the same shall be immediately informed to the concerned police station.

(iv) The applicant shall not leave the jurisdiction of the Court without prior permission of the Court, until filing of ChargeSheet. (v) He shall not contact and/or influence the witness/es and/or tamper with the evidence in any manner whatsoever. 4.

The Anticipatory Bail Application is allowed in the above terms.
