By this petition, the petitioner who is a 74 years old pensioner, has put forth prayer clause 'C' as under :- "C. By way of an appropriate writ, order or direction, respondent No.3 may please be directed to consider the representation dtd. 09.11.2021 of the petitioner and it be held that the petitioner is entitled for Senior and Selection Grade under the Career Advancement Scheme and accordingly his pay be fixed to that effect and consequential reliefs be granted to him, from the date of his appointment." 2.

The learned Advocate submits that the petitioner prays for the benefits from the date of his appointment which is 01.10.1972. The khs/July 2022/7732

- 2 - petitioner has retired on 31.03.2008.

Normally in such matters, wherein the litigants approach this Court for monetary benefits after a long delay, the Courts have not been granting interest and other similar components. In several cases, purely notional benefits are granted. We leave this aspect open, when respondent No.3 would consider the proposal of the petitioner, provided there are sufficient grounds set out by the petitioner, which require consideration.

In view of the above, this petition is disposed off. We expect respondent No.3 to convey it's response to the representation dated 09.11.2021 filed by the petitioner, as expeditiously as possible and preferably on or before 15.10.2022.
