O R D E R

First Appeal No. 1546/2020 is not on board. Taken on Board alongwith First appeal no. 1669/2020.

Learned Counsel Mr. Mohit R. Deshmukh alongwith officer of the insurance company Mr. Irfan Shaikh. respondent/claimants and learned counsel Mr. Adesh Ban h/f Mr. Gore tender on record the terms of settlement which is marked as Exhibit-X. We have ascertained the identification of the claimants with the assistance of learned counsel. The terms settled between them are agreeable to them.

As agreed between the parties, the appellant/Insurance Company shall deposit an amount of Rs.50,000/- (Rs. Fifty

42.FA-1669-2020 -2thousand only) towards full and final settlement of claim within period of eight weeks with Motor Accident Claim Tribunal, Aurangabad. It shall be treated as an undertaking. 4.

The balance amount with accrued interest which is deposited in the High Court shall be transmitted to Motor Accident Claim Tribunal, Aurangabad in M.A.C.P No. 147/2013 forthwith. 5.

The balance amount with accured interest and additional amount of Rs. 50,000/- (Rs. Fifty thousand only) referred above shall be disbursed to the respondent/claimant. 6.

Both the First Appeals are disposed of in terms of the settlement. Award be drawn accordingly. The request of refund of Court fees shall be processed in accordance with law. [A. R. Borulkar] [V. B.
