VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS ...
Advocate for Petitioners : Mr. Panpatte V.S. AGP for Respondents 1 and 2: Mr. S.G. Sangle .....
CORAM : RAVINDRA V. GHUGE AND SANJAY A. DESHMUKH, JJ.
DATED : 30th JANUARY, 2023.
PER COURT :- 1.
By this petition, the petitioners pray that their salaries for the period 15.07.2010 and 26.06.2010, till their termination dated 13.12.2019 and 01.12.2019, respectively are not paid by respondent No.3 management and, therefore, this court should direct the said private management to pay the unpaid salaries of these petitioners. 2.
Having considered the brief submissions of the learned advocate for the petitioners and the learned A.G.P., we find that the petitioners concede that they have been terminated. The said termination has been challenged by both the petitioners before the School Tribunal. Shri Panpatte, the learned advocate relies upon the Government Resolution dated 20.07.2019, vide which the Dispute Redressal Committee has been formed. The colleague employees of these petitioners have already approached the Divisional Deputy
wp958.23 -2Director of Education, who is the Chair Person of the Dispute Redressal Committee.
3.
Since the said remedy has now been provided by the Government and the said Dispute Redressal Committee has been dealing with the dispute of this nature, that this petition is disposed off.
4.
We permit both the petitioners to prepare a comprehensive application to be tendered to the Dispute Redressal Committee, Office of the Divisional Deputy Director of Education, Aurangabad, within 15 days from today.
5.
Needless to state, after receipt of such application, the Dispute Redressal Committee would follow the due procedure in law and decide the claim of these petitioners, by granting a reasonable opportunity of hearing to all the stake holders, expeditiously and in any case, on or before 31.05.2023.
